Law360 (February 9, 2021, 3:15 PM EST) — Fox News is asking a New York court to dismiss a $2.7 billion defamation lawsuit filed by voting technology firm Smartmatic, arguing that the First Amendment clearly gave the network the right to air questionable accusations against the company.
The motion, filed Monday, came less than a week after Smartmatic sued Fox News, along with several of its hosts and frequent guests Rudy Giuliani and Sidney Powell, over accusations that Smartmatic was involved in an effort to rig the 2020 election in favor of Joe Biden.
