The Report on Trump’s 2020 Election Subversion Is Damning
Attorney General Merrick Garland has released former Special Counsel Jack Smith’s report on his investigation into President-elect Donald Trump’s efforts to overturn the results of the 2020 election. The 130-page report is damning, and concludes that “the admissible evidence was sufficient to obtain and sustain a conviction at trial.”
“As set forth in the original and superseding indictments, when it became clear that Mr. Trump had lost the election and that lawful means of challenging the election results had failed, he resorted to a series of criminal efforts to retain power,” the report reads.
The Justice Department charged Trump on four criminal counts related to the effort: conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights. The case was tossed and Smith resigned as special counsel in the aftermath of Trump’s win this November.
Smith’s report details Trump’s scheming to retain power following his loss to President Joe Biden – from pressuring state officials, to the fake electors plot, to Jan. 6, the day he encouraged his supporters to march to the Capitol before they violently attacked it as Congress was preparing to certify Biden’s win.
The report gives a play-by-play of Trump’s day after he finished delivering his speech at the rally before the riot, noting that he watched the chaos unfold on TV, and that he “resisted” pleas from his advisers to issue a statement to calm the crowd, instead “repeatedly remarking that the people at the Capitol were angry because the election had been stolen.”
Trump eventually issued a tweet bashing Vice President Mike Pence, whom Trump believed should have stopped the Electoral College certification. The Secret Service was forced to evacuate Pence to a secure location just a minute after Trump posted his tweet. When Trump was informed about this, he replied, ‘So what?’ according to the report.
The report also makes clear that Trump and his co-conspirators knew exactly what they were doing, and that they “could not have believed the specific fraud claims that they were making because the numbers they touted – for instance, of dead voters in a particular state – frequently vacillated wildly from day to day or were objectively impossible.”
Trump has skirted accountability for all of this by virtue of winning the election in November. His win was certified on Jan. 6 without incident, and he is scheduled to be inaugurated back into office next Monday. He responded to the release of Smith’s report on Truth Social by attacking Smith and the investigation as politically motivated.
“Deranged Jack Smith was unable to successfully prosecute the Political Opponent of his ‘boss,’ Crooked Joe Biden, so he ends up writing yet another ‘Report’ based on information that the Unselect Committee of Political Hacks and Thugs ILLEGALLY DESTROYED AND DELETED, because it showed how totally innocent I was, and how completely guilty Nancy Pelosi, and others, were,” he wrote. “Jack is a lamebrain prosecutor who was unable to get his case tried before the Election, which I won in a landslide.”
“THE VOTERS HAVE SPOKEN!!!” Trump added.
